1. Agreement
These Terms of Service ("Terms") govern your access to and use of Trakiyo, a website design and hosting service operated by each.life, LLC, a limited liability company registered in the United States ("Trakiyo," "we," "our," or "us").
By subscribing to Trakiyo, you ("you" or "Artist") agree to be bound by these Terms. If you do not agree, do not subscribe.
2. The Service
Trakiyo provides:
- A custom-designed music website built on your own domain
- A Trakiyo audio player embedded on your site
- Hosting and maintenance of your site
- Access to the Trakiyo platform and future features as they are developed
All websites are built by hand. No templates are used. The scope of your site is agreed upon during your consultation call.
3. Subscription and Fees
3.1 Monthly Subscription
The Trakiyo service is billed as a monthly recurring subscription processed via Stripe. Your subscription begins on the date of your initial payment or at the end of your free trial period, whichever is later.
- Subscription price: $49.00 USD per month
- Free trial: First 90 days free. No charge until the trial period ends.
3.2 Setup Fee
A one-time setup fee is charged after your consultation call and before work begins on your site. The fee is scoped to the build:
- One-pager — from $150 USD. Single landing page with player, bio, links, and contact / booking form.
- Multi-pager — from $450 USD. Full site (home, music, EPK, tour, contact) with custom design, custom navigation, and full audio player integration.
- Custom build — quoted after the consultation. Label sites, multi-artist rosters, deep integrations, anything bespoke.
The setup fee is invoiced separately via Stripe and covers the cost of building your custom website. The setup fee is non-refundable once work has begun.
3.3 Payment
All payments are processed by Stripe. By subscribing, you authorize each.life, LLC to charge your payment method on a recurring monthly basis. You are responsible for ensuring your payment method remains valid.
Failed payments may result in suspension of your service. We will notify you before suspending your account.
3.4 Price Changes
We reserve the right to change subscription pricing with 30 days' written notice.
4. Free Trial
New subscribers receive a 90-day free trial. No payment is collected during the trial period. At the end of the trial, your subscription begins automatically at $49.00 USD per month unless you cancel before the trial ends.
5. Setup and Build Process
After subscribing, you will be prompted to schedule a consultation call via Cal.com. During this call, we will discuss your music, your brand, and what you need from your Trakiyo site.
Following the consultation, we will invoice the $150 setup fee. Work begins upon receipt of payment. We will keep you involved throughout the build process and share progress as we go.
Before your site goes live, you will have the opportunity to review and request changes. Free edits are included for the first 2 months after your site launches.
6. Music Sales and Payments
Trakiyo handles direct music sales through your custom audio player. Trakiyo takes 0% commission on any music sales made through your Trakiyo website — now and always.
All music sales are processed through Trakiyo's central Stripe account. After each sale:
- Stripe deducts its standard payment processing fee (approximately 2.9% + $0.30 per transaction)
- The remaining amount (100% of net) is paid out to you via Stripe Connect within 5 business days, or instantly for Stripe's standard instant-payout fee
You are responsible for connecting your Stripe Connect account to receive payouts. Trakiyo is not responsible for delays caused by Stripe or your financial institution.
Trakiyo does not process or sell tangible products (vinyl, CDs, tape, merchandise, water bottles, or other physical items). Tangible product sales are handled by you directly through your own commerce arrangements; your Trakiyo website may link out to those sales channels.
6A. Phase 3 Streaming Platform
When the Trakiyo streaming platform ("Phase 3") launches in August 2026, your tracks (uploaded via the Phase 2 Upload Dashboard) will be automatically included in the Trakiyo discovery and streaming service at no additional cost. You may opt out of platform inclusion at any time.
The Phase 3 streaming platform operates on a subscription model paid by fans ("Trakiyo Fan," $8/month). The economics will be governed by a separate Phase 3 Artist Agreement, made available before the platform launches. The Phase 3 model is summarized as follows, subject to the final Phase 3 Artist Agreement:
- Trakiyo's cut: 20% of Trakiyo Fan subscription revenue at launch. Trakiyo's commitment is to reduce this to 10% once the model proves financially sustainable.
- Artist pool: 80% of Trakiyo Fan subscription revenue at launch (90% once cut drops to 10%), distributed via a true user-centric model — each fan's net subscription is allocated only to the artists that fan actually played, proportional to that fan's play count.
- Trakiyo Fan+ perks: Per-artist, per-perk transactions set by the artist. Trakiyo takes 20% at launch (10% once main cut drops); artist receives the remainder direct.
- Trakiyo+ for artists: An optional paid upgrade ($10/month) for additional discovery and promotional visibility on the platform; available only to artists with an active Trakiyo website subscription.
No Phase 3 fees, payouts, or obligations apply until the Phase 3 platform has launched and you have accepted the Phase 3 Artist Agreement.
7. Your Content
You retain full ownership of all music, photos, text, and other content you provide to Trakiyo for use on your site ("Your Content").
By providing Your Content, you grant each.life, LLC a limited, non-exclusive license to host, display, and deliver Your Content solely for the purpose of operating your Trakiyo website.
You represent and warrant that:
- You own or have the right to use all content you provide
- Your content does not infringe any third-party intellectual property rights
- Your content does not violate any applicable laws
We reserve the right to remove content that violates these Terms or applicable law.
8. Domain Ownership
Your domain name is yours. Trakiyo does not own or control your domain. You are responsible for renewing your domain registration. If your domain expires, your site will go offline.
If you cancel your subscription, your domain remains yours. You may take your domain and content elsewhere at any time.
9. Cancellation
9.1 Cancellation by You
You may cancel your subscription at any time through the Stripe Customer Portal. Cancellation takes effect at the end of your current billing period. No partial refunds are issued for unused time.
Upon cancellation, your site will remain live until the end of the billing period, after which hosting will be discontinued.
9.2 Cancellation by Us
We reserve the right to suspend or terminate your account if you:
- Fail to pay your subscription fee
- Violate these Terms
- Use the service for unlawful purposes
We will provide reasonable notice before terminating an account except in cases of serious violations.
9.3 Subscription Terms
Auto-renewal. Subscriptions auto-renew monthly unless cancelled before the next billing cycle. Artists can cancel anytime via account settings or by contacting support.
Cancellation. Payments beyond the current billing cycle are non-refundable. There is no minimum subscription duration.
30-day data window. If cancelled within the first 30 days, all custom build files are deleted. Artist content (audio files, photos, bio, fan data) remains the artist's property and can be exported on request before deletion.
Custom build IP. The custom build itself — including the design, layout, custom audio player implementation, and integration with the Trakiyo platform — is Trakiyo's intellectual property and does not transfer to a different host. The artist owns their content; Trakiyo owns the implementation.
Free trial. The first 90 days of every subscription are free. No charges occur during this period. Artists can cancel during the trial with no obligation.
10. Service Availability
We aim to keep your site available at all times but do not guarantee 100% uptime. Scheduled maintenance, updates, or circumstances beyond our control may cause temporary downtime. We will notify you of planned maintenance where possible.
11. Intellectual Property
The Trakiyo audio player, platform, design system, and all associated software are the intellectual property of each.life, LLC. You may not copy, reverse engineer, or redistribute any part of the Trakiyo platform.
Your custom site design is built for you. Upon payment of the setup fee and while your subscription is active, you have a non-exclusive license to use your Trakiyo-built site. The underlying Trakiyo player code and platform infrastructure remain the property of each.life, LLC.
12. Limitation of Liability
To the maximum extent permitted by law, each.life, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Trakiyo service, including but not limited to lost profits, lost data, or business interruption.
Our total liability to you for any claim arising from or related to these Terms shall not exceed the total amount you paid to us in the 3 months preceding the claim.
13. Disclaimer of Warranties
The Trakiyo service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be error-free, uninterrupted, or free of security vulnerabilities.
14. Governing Law
These Terms are governed by the laws of the State of Nebraska, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Nebraska.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on trakiyo.com at least 30 days before the changes take effect. Continued use of the service after changes take effect constitutes acceptance of the revised Terms.
